Waiver and Release of Liability
By booking and/or staying at any property listed on BookACasa.com (“the Platform”), you (“Guest”) acknowledge and agree to the following terms regarding liability and risk:

Assumption of Risk
You understand and acknowledge that entering, occupying, or using any short-term rental property listed on the Platform involves inherent risks, including but not limited to:
- Slip and fall injuries,
- Use of stairs, balconies, swimming pools, hot tubs, and fireplaces,
- Natural hazards (such as uneven terrain or weather-related conditions),
- Electrical, structural, or mechanical failures,
- Theft, fire, or other accidents.

You voluntarily assume all such risks, whether known or unknown, foreseeable or unforeseeable.

Release of Property Owner and Platform
To the fullest extent permitted by law, you hereby waive, release, and forever discharge:

- The individual property owner (“Host”) of any rented property,
- BookACasa.com and its affiliates, officers, directors, employees, contractors, and agents, from any and all claims, demands, causes of action, losses, liabilities, damages,
or expenses (including attorney’s fees) arising from or in connection with:

- Personal injury (including death),
- Property damage or theft,
- Loss of use, inconvenience, or emotional distress,
- Any condition or defect in the property,
- Actions or omissions of the Host, Guest, or any other individuals present at the property.

This release applies regardless of whether the alleged liability arises from negligence,
strict liability, premises liability, or any other legal theory.

Indemnification
You agree to indemnify, defend, and hold harmless both the property owner and
BookACasa.com from and against any claims, suits, damages, losses, or expenses
(including legal fees) arising out of or related to:
- Your breach of these Terms,
- Your use or misuse of the property,
- The actions or omissions of any person you allow onto the property during your
stay.

Medical Emergencies
BookACasa.com and the property owner assume no responsibility for delays in
emergency response or outcomes related to medical incidents that occur on the
property.

Important: You are encouraged to maintain personal travel, health, and liability insurance coverage. Neither BookACasa.com nor the Host is responsible for lost, stolen, or damaged personal belongings during your stay.
